Language of reference. This policy is a translation of the French version, available at yoogi.ca/confidentialite. Should there be any discrepancy between the two, the French version prevails.
1. Who is responsible for your information
This site is operated by yoogi.ca, a digital media buying agency based in Laval, Quebec.
Under the Act respecting the protection of personal information in the private sector (as amended by Law 25), the person responsible for the protection of personal information is:
Ugo Charbonneau, Director of Operations
admin@yoogi.ca
Laval, Quebec, Canada
Write to this address for any question, any request for access, correction or withdrawal of consent, and to file a complaint.
2. The information we collect
2.1 What you give us
When you fill out the free audit request form, we collect:
- your full name;
- your email address;
- your phone number;
- your company name and its website address;
- the addresses of your Instagram, Facebook and LinkedIn pages, if you choose to give them to us (those fields are optional).
This information is provided voluntarily. You are not required to fill out the form to browse the site.
2.2 What is collected automatically
Subject to your consent (see section 4), our analytics and advertising tools may collect: your IP address, your device and browser type, your language, the pages you view and the time you spend on them, as well as the site or ad you arrived from.
We also review publicly available information about your business (website, social pages, the platforms' public ad libraries) in order to prepare the audit you requested.
3. Why we use it
- To prepare and deliver the audit you requested.
- To communicate with you about it, by email or phone, and to present the results.
- To follow up commercially on your request (see section 9).
- To measure and improve the performance of our site and our ad campaigns.
- To meet our legal and accounting obligations.
We do not use your information for any other purpose without informing you and, where the law requires it, without obtaining your consent.
4. Cookies and tracking technologies
A cookie is a small file placed on your device. We use two kinds:
- Necessary cookies, essential to the operation of the site (security, remembering your cookie choice). These cannot be turned off.
- Analytics and advertising cookies, used to understand how the site is used and to measure our campaigns.
Analytics and advertising cookies are only placed after your explicit consent, given through the banner shown on your first visit. You may change or withdraw that choice at any time, with no effect on your browsing. You can also block or delete cookies from your browser settings.
The tools that may be activated after your consent are:
- Google Analytics 4 and Google Tag Manager (audience measurement and tag management);
- the advertising pixels and tags of Google Ads, Meta (Facebook and Instagram), TikTok, LinkedIn, Snapchat, Pinterest, Reddit and Spotify.
These tools belong to third parties, who act as controllers of their own processing. We encourage you to review their respective policies to understand how they use the data they collect.
5. Automated processing and AI qualification
We use an automated system, including artificial intelligence components, to qualify and sort incoming audit requests. Among other things, this system assesses the industry, the existing online advertising presence, and the consistency of the information provided.
If a decision concerning you is based exclusively on this automated processing, you have the right:
- to be informed of it at the time of the decision;
- to know which personal information was used, the main factors that led to the decision, and how to have that information corrected;
- to submit your observations and to request that a natural person review the decision.
To exercise these rights, write to admin@yoogi.ca.
6. Who your information is shared with
We do not sell or rent your personal information. We share it only with the providers necessary to deliver the service, and only to the extent required:
- Zoho — customer relationship management (your contact details and the status of your request);
- Cloudflare — site hosting and security;
- Google — audience measurement and business email;
- the advertising platforms listed in section 4, to measure our campaigns.
We may also disclose information where the law requires it, or to assert our rights.
7. Information stored outside Quebec
The providers listed above may host or process your information outside Quebec, notably in the United States and in the European Union. Before entrusting personal information to them, we carry out a privacy impact assessment to satisfy ourselves that it receives adequate protection, and our agreements include confidentiality and security commitments.
You may ask us for more detail about those assessments by writing to admin@yoogi.ca.
8. How long we keep it
- Audit requests that did not convert — kept for 24 months after the last exchange, then destroyed or anonymized.
- Clients — kept for the duration of the business relationship, then 7 years after it ends, to meet our accounting and tax obligations.
- Site analytics data — kept for at most 14 months, depending on the settings of the tools concerned.
You may request deletion of your information before those deadlines (section 10).
9. Commercial communications
When you request an audit, you give us your contact details so that we can act on it. Under Canada's Anti-Spam Legislation, that request constitutes implied consent allowing us to write to you about your audit and our related services.
Every email includes an unsubscribe link, and you may also ask us at any time to stop writing to you. We do not add you to any newsletter without your express consent.
10. Your rights
Quebec law grants you the following rights:
- Access — obtain a copy of the information we hold about you.
- Correction — have inaccurate, incomplete or ambiguous information corrected.
- Withdrawal of consent — withdraw at any time the consent you have given.
- Deletion and de-indexing — request that the dissemination of information cease, or that a hyperlink giving access to it be removed.
- Portability — receive, in a structured and commonly used technological format, the computerized information you provided to us.
- Human review of an automated decision (section 5).
Write to admin@yoogi.ca. We respond within a maximum of 30 days. We may need to verify your identity before acting on your request.
11. Security
The site is served over HTTPS. Access to information is limited to the people who need it, and our providers are bound by contractual security obligations. Since no method of transmission over the Internet is infallible, we cannot guarantee absolute security.
12. Privacy incidents
We keep a register of privacy incidents. Where an incident presents a risk of serious injury, we promptly notify the Commission d'accès à l'information du Québec as well as the individuals concerned.
13. Minors
Our services are intended for businesses and for adults. We do not knowingly collect information about a child under 14. Should that occur, write to us and we will delete it.
14. Changes to this policy
We may amend this policy. The date of the last update appears at the top of the page. If there is a significant change in how we handle your information, we will inform you by reasonable means.
15. Filing a complaint
If our response does not satisfy you, you may file a complaint with the Commission d'accès à l'information du Québec (cai.gouv.qc.ca), or with the Office of the Privacy Commissioner of Canada (priv.gc.ca).
